Terms of Service

1. Acceptance of Terms

By accessing or using BA | Stamp ("the Service"), operated at bastamp.com, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These Terms apply to all users, including registered account holders, visitors, and anyone who accesses the Service.

2. Description of Services

BA | Stamp provides blockchain timestamping services: • Document Timestamping — Client-side SHA-256 hashing of your files, with the resulting hash anchored to the Polygon blockchain via a Merkle tree. Your files never leave your device. • Cryptographic Certificates — PDF certificates containing the Merkle proof, on-chain transaction reference, and verification instructions. • Bitcoin Secondary Anchor — Optional secondary attestation via OpenTimestamps on the Bitcoin blockchain. • Public Verification — A public verification page for each timestamp, allowing any third party to independently verify the proof.

3. Account Registration

• You must provide a valid email address when creating an account • You are responsible for maintaining the security of your account credentials • One account per person or legal entity • You must be at least 18 years old to use our services • You must promptly notify us of any unauthorized use of your account

4. How the Service Works

4.1 Client-Side Hashing. Files are hashed entirely in your browser using SHA-256. Only the 64-character hash is transmitted to our servers. We never receive, store, or process your original files. 4.2 Blockchain Anchoring. Hashes are batched and anchored to the Polygon blockchain via a Merkle root. Batching occurs periodically. The on-chain transaction provides a tamper-proof timestamp. 4.3 Certificates. Upon anchoring, a PDF certificate is generated containing the Merkle proof, block time, and step-by-step verification instructions. Certificates are self-verifiable — they do not depend on the continued availability of BA | Stamp. 4.4 No Guarantee of Perpetuity. While blockchain data is designed to be permanent, we cannot guarantee the perpetual availability of any specific blockchain network. The dual-anchor approach (Polygon + Bitcoin) mitigates this risk.

5. Pricing & Payment

• Prices are listed in EUR, USD, and GBP • Payment is required before timestamps are anchored • Stamp credits are consumed upon submission and are non-transferable • We reserve the right to change prices with 30 days' notice • All payments are processed securely through Stripe

6. Refund Policy

• Unused credits: Refundable within 14 days of purchase if no stamps have been used from the pack • Used credits: Non-refundable once a stamp has been submitted, as the hash has been queued for anchoring • Errors: If a timestamp fails due to a platform error, the credit is automatically restored to your account

7. Limitations & Disclaimers

7.1 NOT LEGAL ADVICE. BA | Stamp provides technical timestamping infrastructure, not legal advice. The evidentiary weight of a blockchain timestamp varies by jurisdiction. Consult a qualified legal professional for specific legal questions. 7.2 EVIDENTIARY VALUE. Our certificates reference applicable legal frameworks (eIDAS 2.0, Art. 2712 c.c., FRE 901(b)(9), and others) for informational purposes only. Admissibility and probative value are determined by the relevant court or authority. 7.3 NO WARRANTY. The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Intellectual Property

• The BA | Stamp platform, brand, and certificate design are the intellectual property of Aletheia Tech Ltd • The smart contract source code is publicly verified on Polygonscan • Generated certificates are yours to use, share, and present as needed • The verification logic is open and documented — you may independently verify any timestamp without our platform

9. Acceptable Use

You agree NOT to: • Use the Service to facilitate any illegal activity • Submit false or misleading information • Attempt to reverse-engineer or interfere with the platform infrastructure • Overwhelm our systems with excessive automated requests • Share account credentials with unauthorized parties

10. Data & Privacy

We store only: • Your email address (for authentication) • File hashes you submit (not the files themselves) • Optional metadata you provide (filename, size, mime type) • Merkle proofs and blockchain transaction references • Payment records Your files never leave your device. 11. Limitation of Liability

To the maximum extent permitted by applicable law: • Our total aggregate liability is limited to the amount you paid for the specific service giving rise to the claim • We are not liable for indirect, incidental, special, consequential, or punitive damages • We are not liable for the availability or performance of third-party blockchain networks • We are not liable for any legal interpretation of the evidentiary value of timestamps in any jurisdiction

12. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts of England and Wales.

13. Termination

• You may close your account at any time by contacting us • We may suspend or terminate accounts that violate these Terms • Upon termination, your existing certificates remain valid — they are self-verifiable and do not depend on your account • Sections relating to intellectual property, limitation of liability, and governing law survive termination

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance.
